The FCC Is Weighing a Retroactive Drone Ban: What Part 107 Pilots Need to Know
The FCC has opened PS Docket No. 26-189, a proposal to prohibit the importation and marketing of certain foreign-produced "military-grade" drones and critical components. Rotor Rate filed a formal comment in this docket on August 10, 2026. Here is what the notice says, what it would mean for inspection, agriculture, search and rescue, and public safety work, and how to file your own comment before the window closes.
On July 29th, the Federal Communications Commission (FCC) released a Public Notice that could reshape what equipment you can buy, sell, and maintain in the United States. The notice, filed under PS Docket No. 26-189, proposes to prohibit the importation and marketing of certain foreign-produced "military-grade" uncrewed aircraft systems (UAS) and UAS critical components [1]. The comment window closes in early September 2026. If you fly a DJI, Autel, or similar foreign-made aircraft for work, this affects you.
This is not a final rule. It is a request for comment. But the proposal reaches backward: it targets equipment that already holds FCC certification, not only future models.
What the proposal actually says
The FCC's action rests on the Secure and Trusted Communications Networks Act of 2019. In late 2025, the Commission added foreign-produced UAS and critical components to its Covered List. The current Public Notice (DA 26-758) asks whether to extend the existing import and marketing prohibition to Covered List UAS that also meet a proposed "military-grade" definition [1].
Two things it does not do, at least as written:
- It does not ban flying. The notice exempts continued use or operation of already-purchased aircraft.
- It does not, by itself, adopt a rule. It gathers a record.
What it would do is stop new units and components from entering or being marketed in the U.S. market — which, over a few seasons, is functionally a slow ground-stop for anyone who needs a replacement battery, a warranty repair, or a firmware update.
Why this matters for small operators
DJI holds an estimated 70% or more of the U.S. commercial drone market, according to industry estimates cited by the Special Competitive Studies Project [3].
An Inspired Flight IF800 LiDAR (light detection and ranging) mapping kit is listed at roughly $57,340, and its NDAA-compliant thermal inspection kit at roughly $52,650 [5][6]. A comparable foreign-produced Matrice-class setup with a thermal or zoom payload typically lands between $10,000 and $25,000. That is a $20,000 to $40,000 gap... per airframe.
For a one-person Part 107 business, a forced fleet replacement at those prices is not a budget line item. It is a business-ending event. The same is true for volunteer search-and-rescue teams, small police departments, and family farms that built operations around the only affordable hardware on the market.

The safety trade-off nobody is talking about
Drones are not just cameras. They are safety tools.
When you inspect a roof with a drone instead of climbing it, you remove a fall hazard. The Centers for Disease Control and Prevention (CDC) and CPWR have documented that falls to a lower level are a leading cause of construction fatalities, with roof falls a significant subset [7]. If operators cannot afford or obtain thermal, zoom, or LiDAR-equipped aircraft, the fallback is not a domestic drone. It is a ladder and a bucket truck.
In agriculture, the National Transportation Safety Board's (NTSB) special investigation report on agricultural aircraft operations documented 78 ag-aviation-related accidents in 2013 alone [8]. Pushing spray and scouting work back toward manned low-altitude flying moves risk in the wrong direction.
In search and rescue (SAR), a peer-reviewed study found that drones can reduce the treatment-free interval in simulated mountain rescue with telemedical support [9]. Volunteer teams run thermal aircraft in the low four figures to roughly $15,000. A $50,000 alternative is not a substitute; it is a program cancellation.
What Rotor Rate is asking the FCC to do
We support securing the communications supply chain; however, we are asking that the tool match the threat:
- Define "military-grade" with objective, published criteria rather than case-by-case interpretation.
- Apply any prohibition prospectively, not to already-certified equipment.
- Provide at least a 24-month transition for small operators and public-safety agencies.
- Preserve firmware updates, replacement parts, and repair channels for units already in service.
- Separate radio-frequency (RF) critical aircraft components from non-RF payloads such as thermal, LiDAR, and multispectral sensors. A gimbal is not a radio.
- Conduct a full rulemaking that includes a small-business economic-impact analysis.
How to file your own comment
You do not need a lawyer, and you do not need to be an association.
- Go to the FCC's Electronic Comment Filing System (ECFS) at fcc.gov/ecfs and search for PS Docket No. 26-189 [2].
- Choose the Express Comment form and enter `26-189` as the proceeding.
- Write in your own words. Say where you operate, what equipment you fly, what work you do with it, and what specifically happens to your business if replacement units, parts, or firmware stop being available.
- Submit before the deadline in early September 2026.
Specific beats loud. "I fly a thermal Matrice for insurance roof inspections in central Alabama, and the NDAA-compliant equivalent costs three times what my aircraft cost" carries more weight than a form letter. The bottom line
Supply-chain security is a real concern, and reasonable people can disagree about how aggressive the remedy should be. But a broad, retroactive prohibition on already-certified equipment would land hardest on the operators who are not the security risk this proceeding targets: the solo inspection pilot, the volunteer SAR team, the two-truck ag operation, the small-town police department, just to name a few.
